Article 1 — Definitions
1.1 Event: An organized event, including but not limited to New Year's Eve parties, musical performances, festivals, dinners, and celebrations organized by The New Event (Amsterdam Nightlife).
1.2 User: Any natural or legal person who purchases tickets for an Event organized by The New Event (Amsterdam Nightlife) via amsterdamnye.com.
1.3 Terms and Conditions: These terms and conditions for the purchase of tickets for Events organized by The New Event (Amsterdam Nightlife).
1.4 Ticket: An entry ticket for an Event organized by The New Event (Amsterdam Nightlife), including General Admission, VIP, Dinner+Party, hotel packages, and all other ticket types offered.
1.5 Service charges: The costs charged by The New Event (Amsterdam Nightlife) to the User for the purchase of a ticket, including transaction and booking fees.
1.6 The New Event (Amsterdam Nightlife): The organization responsible for all NYE events listed on amsterdamnye.com, with its office at Herengracht 221, 1016 BG Amsterdam.
1.7 Intellectual Property Rights: All rights to intellectual property and rights associated therewith, such as copyrights, trademark rights, patent rights, design rights, trade name rights, database rights, and neighbouring rights.
Article 2 — Purchase of Tickets
2.1 If a User wishes to purchase a ticket, the User must go through the ordering process on amsterdamnye.com. During the ordering process, the User will provide certain information needed to complete the order. The User guarantees that this information is accurate, current, and truthful.
2.2 After purchasing a ticket, the User can download the ticket immediately upon payment. The User receives a confirmation email within 60 minutes to the email address provided. This confirmation provides the User with another opportunity to download the Ticket(s).
2.3 If problems occur with the order system, the User can contact The New Event (Amsterdam Nightlife) via the contact form on amsterdamnye.com or via contact@nightlifeticket.nl.
2.4 The User acknowledges that the use of tickets and access to Events may be subject to further conditions of The New Event (Amsterdam Nightlife), including dress codes, age restrictions, and venue-specific rules.
2.5 No-Refund Policy: The purchase of tickets relates to leisure activities in accordance with Article 7:46i paragraph 3 of the Dutch Civil Code. Therefore, the User does not have the right to terminate the agreement without giving reasons as referred to in Article 7:46d of the Dutch Civil Code. Tickets are non-refundable, non-exchangeable, and non-transferable for monetary value. The only exception is if The New Event (Amsterdam Nightlife) cancels the Event itself, as described in Article 3.
2.6 Delivered tickets remain the property of The New Event (Amsterdam Nightlife). It is not permitted without prior written permission of The New Event (Amsterdam Nightlife) to:
- Sell tickets to third parties;
- Otherwise commercially exploit tickets, directly or indirectly, to third parties;
- Offer tickets in any form of commercial expression or otherwise refer to the tickets commercially.
If a situation as described above occurs, The New Event (Amsterdam Nightlife) will invalidate the ticket. Holders of such tickets will be denied entry to the Event without the right to any form of compensation.
2.7 Only the named holder of the ticket has legitimate access to the Events. Identification may be required at the entrance.
2.8 The New Event (Amsterdam Nightlife) reserves the right to set a maximum number of tickets per User. Reservations or purchases exceeding this limit will be adjusted or cancelled.
2.9 The New Event (Amsterdam Nightlife) does not accept liability for any damages incurred by the User as a result of the unavailability of tickets and/or inaccurate or false information about the availability of tickets, as well as data changes and cancellations of Events.
2.10 The User may only use coupons and/or vouchers if offered during the ordering process. Coupons and/or vouchers are only valid when issued by The New Event (Amsterdam Nightlife).
2.11 The New Event (Amsterdam Nightlife) reserves the right at all times to refuse orders from Users.
2.12 In case of any measures taken by the government which cause the participating venues/events to be closed, the User will receive a value voucher that can be used within 2 years from the purchase date.
Article 3 — Cancellation or Rescheduling of Events
3.1 The New Event (Amsterdam Nightlife) reserves the right to cancel or reschedule its organized Events if necessary according to standards of reasonableness and fairness, including but not limited to economic reasons and/or force majeure.
3.2 Force majeure includes: war, threat of war and riots, restrictive measures by domestic or foreign governments, serious calamities, fire, strikes, failure and damage to equipment and operating systems, obstruction or strike of public transport, flooding, sabotage, and in general all unforeseen circumstances both in the Netherlands and abroad as a result of which compliance with the Agreement cannot reasonably be expected from The New Event (Amsterdam Nightlife).
3.3 The New Event (Amsterdam Nightlife) does not accept liability for damage caused by cancellation or postponement of an Event, nor for the quality of the Event and/or the venue where the Event is held.
3.4 If and insofar as the Event is cancelled by The New Event (Amsterdam Nightlife), the ticket price will be reimbursed, provided that compliance is demonstrable. Service charges paid by the User will not be refunded. The New Event (Amsterdam Nightlife) accepts no liability for any direct or indirect costs, expenses, or other damages that the User may suffer.
3.5 If the Event is rescheduled rather than cancelled, tickets remain valid for the rescheduled date. The User is not entitled to a refund in case of rescheduling.
Article 4 — Warranties and Indemnities
4.1 The User indemnifies The New Event (Amsterdam Nightlife) against claims of third parties based on the assertion that the User, by using amsterdamnye.com, carried out activities in any way unlawful.
4.2 The User guarantees that when purchasing tickets:
- No robots, spiders, scrapers, or other applications will be used which bring about actions other than those intended by the ordering software;
- No applications will be used to monitor the system software and/or copy the system.
Article 5 — Payment
5.1 The User pays the prices as reported by The New Event (Amsterdam Nightlife) on amsterdamnye.com. Service charges will be added to the original ticket price.
5.2 Prices include legal VAT unless otherwise stated. Prices may change without notice. The price indicated in the order process is binding.
5.3 The New Event (Amsterdam Nightlife) accepts no liability for errors in the ordering of tickets, for instance with regard to the number of tickets and/or type of Event. It is not possible to cancel tickets or exchange them.
5.4 If The New Event (Amsterdam Nightlife) has decided to refund the amount paid for a ticket (only in case of Event cancellation by the organizer), this never includes the service charges.
5.5 The system software of amsterdamnye.com is secured so that abuse of data can be excluded with a reasonable degree of certainty. Payments are processed through Stripe, a PCI-DSS compliant payment service provider.
Article 6 — Interruption of Order Options
6.1 The New Event (Amsterdam Nightlife) has the right, without notice and without being liable to compensate the User, to shut down the system software temporarily and/or to limit its use if necessary, for example in the context of reasonably necessary maintenance of the software and/or website.
6.2 The New Event (Amsterdam Nightlife) is entitled, without prior notification, to make procedural and technical changes and/or improvements to the system software.
Article 7 — Privacy
7.1 While using amsterdamnye.com and the ordering software, the User provides (personal) information to The New Event (Amsterdam Nightlife). This information is stored and processed in accordance with the General Data Protection Regulation (GDPR) and the Dutch Data Protection Act. This information is not provided to third parties unless The New Event (Amsterdam Nightlife) is bound to do so by law or in defence of its rights.
7.2 If the User explicitly gives permission, this information will be used for commercial purposes, including direct marketing. The User has the right to object to processing for commercial and direct marketing purposes at any time. See our Privacy Policy for full details.
Article 8 — Hotel Bookings
8.1 For Events that include hotel room bookings, the User acknowledges that hotel room availability is limited and subject to separate stock management.
8.2 Hotel rooms are booked as part of an Event package. Check-in and check-out dates are as specified in the Event description.
8.3 Hotel rooms cannot be cancelled or refunded separately from the Event ticket package.
8.4 The New Event (Amsterdam Nightlife) is not responsible for the quality of hotel services; these are provided by the respective hotel partners.
Article 9 — VIP and Upgrade Packages
9.1 VIP tickets, upgrades, and add-on products are subject to availability. The New Event (Amsterdam Nightlife) reserves the right to modify VIP inclusions without prior notice.
9.2 Upgrades purchased after the initial ticket purchase (after-sales) are final and non-refundable.
9.3 If a User upgrades from a standard ticket to a VIP ticket, the original standard ticket becomes invalid. A new VIP ticket with QR code will be issued.
Article 10 — QR Codes and Entry
10.1 Each ticket contains a unique, signed QR code. This QR code is the sole means of entry validation at the Event.
10.2 QR codes may only be scanned once. Duplicate scans are detected and rejected. Tampering with or forging QR codes is prohibited and may result in denied entry and legal action.
10.3 The User is responsible for ensuring their QR code is accessible at the time of entry (via phone or printed copy).
Article 11 — Applicable Law
11.1 These Terms and Conditions are governed by Dutch law.
11.2 Any disputes arising from or relating to these Terms and Conditions or the purchase of tickets shall be submitted to the competent court in Amsterdam, The Netherlands.
11.3 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
